Probate Clearance in the Algarve: A Guide for Overseas Families

Losing a loved one from another country

An Algarve property left in the will is a gift wrapped inside a problem. You are grieving. You are in another country. You have Portuguese paperwork, a house full of belongings you have never seen, and no obvious first step. This guide is what we tell families who call us in exactly that situation.

Step 1: Do not fly out yet

Most overseas families assume they need to fly to the Algarve to sort the villa. In almost every case, you do not. A reputable probate clearance company handles everything remotely — coordinating with your Portuguese lawyer for keys, sending you a photo inventory before anything moves, and packing any keepsakes to post to you.

Step 2: Wait for the probate paperwork

You cannot legally clear the property until probate (habilitação de herdeiros) is finalised and the heirs are recognised. In Portugal this typically takes 3–6 months. Your Portuguese lawyer or solicitador handles this. Ask them to confirm before any clearance work starts.

Step 3: Decide what stays for the family

Before anything is removed, write a keepsakes list. Common items:

• Photo albums and personal papers (always kept — even if the family does not ask)
• Jewellery and watches
• Small furniture with sentimental value
• Books that were personal to the deceased
• Any art, or anything valuable that should be professionally valued before sale

The clearance company should photograph each of these before removal and set them aside for you.

Step 4: The photo inventory

Before anything moves, insist on a photo inventory — every room, every cupboard, garage, loft. This protects you against later "there was cash in the drawer" disputes between heirs, and gives you the chance to say "hold that, ship it to me".

Step 5: Valuables get logged, not disposed of

Anything of possible value — jewellery, watches, small art, foreign currency, documents — should be photographed, logged, and handed to your lawyer or executor. Never disposed of. This is the single most important guarantee to insist on.

Step 6: Everything else, sorted three ways

1. Donation. Usable furniture, clothes, homeware to local Algarve charities and second-hand routes.
2. Recycling. Metal, glass, electronics, mattresses through licensed streams.
3. Disposal. Only what cannot be reused or recycled goes to the municipal ecocentro.

Step 7: Sale-ready handover

Once cleared, most families sell the property. A cleared villa with an optional deep clean and exterior pressure wash sells faster and for more. Ask the clearance company if they can bundle the exterior clean — most Algarve firms that do both remove a coordination headache.
